You found the perfect home, signed a purchase agreement and arranged financing. Then the seller backs out days before closing. Indiana law gives buyers legal tools to respond – including the right to ask a court to compel the seller to complete the sale. Whether that remedy applies depends on the specific facts of the contract and what happened.

How purchase agreements create binding duties

A signed purchase agreement creates a legally binding contract between buyer and seller. When both parties sign, they agree to complete the transaction under the stated terms. The seller’s duty to transfer title becomes a legal obligation – not merely a promise the seller can abandon without consequence.

What specific performance means for buyers

Specific performance is a legal remedy that compels the seller to complete the sale as agreed. Courts may order this remedy when monetary damages would not adequately compensate the buyer. Real estate is unique under state law, making each property irreplaceable. A buyer who proves the seller breached the contract without valid grounds can ask the court for specific performance.

When sellers have valid grounds to withdraw

If a court declines to order specific performance, you may still be able to recover monetary damages – including your earnest money, inspection costs and financing fees.

Specific performance is a meaningful legal option for Indiana buyers whose sellers walk away without a valid contractual reason. Because the outcome turns on what the agreement actually says and whether both parties met their obligations, understanding the contract terms is where any analysis of available remedies begins.
